Terms of service
Effective 20 October 2026
These terms apply when you use nivor.technology or buy a film or plan from Nivor ("we", "us"). Nivor is operated by Robert Jacobs, a sole proprietor in Frankfort, Kentucky. By using the site or paying for a plan, you agree to them. If you're buying for a company, you confirm you're authorised to bind it, and "you" means that company.
Our films and plans are sold to businesses for business use, not to consumers for personal or household use.
If you sign a separate client agreement with us, that agreement controls where it differs from these terms.
1. What we provide
We make short launch videos ("films") for software products: script, voice, motion, captions and sound, cut in 16:9, 4:5 and 9:16. Each plan's films, turnaround and revisions are described on our plans section at the time you buy:
- Launch Film: one film, a one-time payment.
- Launch, Growth and Scale: a set number of films each month, billed monthly.
Turnaround times are business days and start when we have everything we need from you (see section 3). They're targets we work hard to hit, not guarantees.
2. How a film is made
- Brief: you send your product details, audience and goal.
- Script and fact table: we send a script and a list of every claim the film makes. Nothing is animated until you approve both in writing (email is fine).
- First cut: we deliver a first cut in each agreed format.
- Revisions: each film includes two rounds of revisions. A round is one consolidated list of changes. Changes to an approved script, or more rounds, may cost extra; we'll quote before doing them.
- Approval: if you don't respond to a script, cut or final delivery within 10 business days, we'll send you a reminder. If you still haven't responded 5 business days after the reminder, that version counts as approved.
3. Your part
- Give us accurate information and the materials we ask for (product access or screen recordings, brand assets) on time. Delays on your side move our delivery dates.
- You're responsible for the facts in your film. We show you every claim before we animate; your approval confirms they're true and that you can make them.
- You confirm you have the rights to everything you send us (logos, screenshots, names, footage, customer details) and that our using them to make your film won't break any law or anyone's rights.
- Don't ask us to make anything false, misleading, defamatory or unlawful, or anything that impersonates a real person. We can decline such requests.
4. Payment
- Prices are in US dollars and shown on the site at the time you buy. Payments are processed by Stripe. Taxes, if any, are added where the law requires.
- One-time films are paid in full upfront.
- Monthly plans renew automatically each month on the same date, at the same price, and charge your saved card until you cancel. When you subscribe, we'll email you a confirmation that sets out your plan, price, billing date and how to cancel. We'll email you a receipt for every charge, and give you at least 30 days' notice of any price change.
- Founding price: where offered, the founding price is limited to the number of clients stated and is given in exchange for permission to feature your finished film in our portfolio. We may also ask for an honest review. Leaving one is optional, it doesn't have to be positive, and if we publish it, we'll say you received a discount.
5. Cancelling and refunds
- Monthly plans: cancel at any time by emailing hello@nivor.technology. We'll confirm your cancellation by email. Cancellation stops future charges; the plan runs to the end of the month you've paid for. Films already started that month are still delivered. Unused films don't carry over to the next month and aren't refunded.
- One-time films: if you cancel before you approve the script, we refund you in full. After script approval, work is underway and payments aren't refundable, except where the law says otherwise.
- If we can't deliver a film we've been paid for, we'll refund you for it.
6. Who owns what
- Your film: once you've paid in full for it, you own the final delivered film files and can use them anywhere, forever, with no further fees.
- Your materials: stay yours. You let us use them only to make your film.
- Our tools: we keep ownership of our software, templates, motion systems, methods and anything we made before or outside your project. The parts that appear in your film are licensed to you, permanently and for free, as part of the film.
- Third-party elements: some films include licensed elements such as fonts, synthetic voices or music. Your right to use those comes with the film, but you can't extract them and use them separately.
- AI-generated parts: some parts of a film, such as a synthetic voice, are generated with AI tools. US copyright law may not protect purely AI-generated material, so we can't promise you exclusive copyright in those parts. We transfer whatever rights we hold in them to you, and we only use AI tools whose terms allow you to use the output commercially.
- Our portfolio: we only show your film or name you as a client with your permission, and never before your launch.
7. Confidentiality
We keep your unreleased product information confidential and only use it to make your film. Nothing about your product is shared before your launch date. This doesn't cover information that's already public, that we already knew, or that we're legally required to disclose. We're happy to sign your NDA.
8. AI
We use AI tools to help draft scripts, voices and edits; people direct and check every film. We use synthetic voices generated on paid plans that include commercial-use rights, and never a clone of a real person's voice without their written permission. We don't use your confidential materials to train AI models.
9. What we don't promise
We promise to make your film with care and skill, as described in these terms. We don't promise views, signups, sales, or any other result, and we don't guarantee the site will always be available or error-free. Apart from what these terms say, the site and our services are provided "as is", to the extent the law allows.
10. Limits on liability
To the extent the law allows: neither of us is liable to the other for indirect or consequential losses, such as lost profits, revenue or data. Our total liability for any claim relating to our services is limited to the amount you paid us in the 3 months before the claim arose. Nothing in these terms limits liability that can't be limited by law.
11. Claims about your content
If someone brings a claim against us because of materials or facts you provided or approved, you'll cover our reasonable costs of dealing with it. If someone claims that something we created for your film (and that you didn't supply) infringes their rights, we'll fix or replace it, or refund you for that film.
12. Using the site
Don't misuse the site: no attempts to break in, overload it, scrape it, or submit false information through its forms. The site's content, design and our films shown on it belong to us or our licensors. Third-party names and videos shown in our Launch Teardowns belong to their owners, are used for commentary, and don't imply any connection to or endorsement by them. If you own something shown there and want it changed or removed, email hello@nivor.technology and we'll respond within 5 business days.
13. Ending the relationship
Either of us can end a monthly plan at the end of a billing month. We can stop work immediately if you don't pay or seriously break these terms. Sections 6, 7, 9, 10, 11 and 14 still apply after things end.
14. Disputes
These terms are governed by the laws of the Commonwealth of Kentucky, USA. If a dispute comes up, email us first and we'll try to sort it out within 30 days. If we can't, the state and federal courts in Franklin County, Kentucky have exclusive jurisdiction, unless the law where you live says otherwise.
15. Other things
We may update these terms; the date at the top shows the current version, and the version in place when you buy applies to that purchase. If part of these terms is unenforceable, the rest still applies. You can't transfer your rights under these terms without our agreement. These terms, with any client agreement we sign, are the whole agreement between us about our services.
